WAIVER AND RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE AGREEING TO THIS WAIVER. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
I, on my own behalf, and on behalf of any minors for which I am legally responsible (“My Dependent(s)”) acknowledge and understand that the facilities, equipment, services, activities, and premises used by PFA Sports Academy LLC ("PFA") involve inherent risks and dangers to persons or property, including but not limited to, physical exertion, potential contact with others, the use of specialized equipment, physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, paralysis, and/or death. While particular rules, instruction, equipment and personal discipline may reduce the risk, it does not eliminate that risk.
I, ON MY OWN BEHALF, AND ON BEHALF OF MY DEPENDENT(S), HEREBY AGREE THAT ALL ACTIVITIES, USE OF EQUIPMENT AND FACILITIES, PRESENCE OR PARTICIPATION IN ANY WAY ARE UNDERTAKEN BY THE UNDERSIGNED AT HIS/HER/THEIR OWN RISK.
With this understanding, I WILLINGLY AGREE TO ASSUME FULL RESPONSIBILITY FOR ANY AND ALL RISKS, INJURIES, DAMAGES, OR LOSSES, whether known or unknown, that may occur as a result of my or any dependents’ participation in the activities with PFA or use of equipment, facilities and premises, including such risks arising out of or in any way connected with my or any dependents’ presence, in, upon or about the premises, whether caused by the negligence of PFA or otherwise.
I, AND MY DEPENDENTS’ UNDERSTAND AND AGREE THAT IT IS MY RESPONSIBILITY TO ADHERE TO ANY AND ALL INSTRUCTIONS OR GUIDELINES PROVIDED BY PFA, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS, AND TO EXERCISE CAUTION AND JUDGMENT DURING MY INVOLVEMENT AND PARTICIPATION.
IN CONSIDERATION of being allowed to participate for any purpose, including, but not limited to, observation, use of facilities or equipment, or participation in any way of the activities of PFA I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE PFA, its directors, officers, employees, and agents for any and all liability for claims, demands, actions, causes of action, costs, and expenses which I or any dependents may incur or have against PFA, arising from, but not limited to, personal injury, accidents, illnesses (including death), or property loss or damage, that may result from participation in activities, classes, observation, or use of facilities, premises, or equipment including those arising out of any negligence of PFA or otherwise.
By agreeing to this waiver, I acknowledge:
1. That I have carefully read and fully understand the terms of this release of liability. I am aware that I am voluntarily giving up substantial rights by signing this document, and I do so freely and willingly without any inducement of any kind.
2. That my dependent is in good physical health, and the last physical exam of him/her was done by a licensed physician within the last 12 months with no physical limitations noted.
3. That my dependent has current medical insurance as required by law. I agree to provide a copy to PFA upon request.
4. If during participation I observe any unusual or significant hazard during my presence or observation, I will remove myself from such danger and bring it to the attention of the nearest official, immediately.
